What you need to know about your parental rights in Georgia
What is legitimation and why is it necessary?
In Georgia, legitimation is the legal process by which a biological father becomes the child’s legal father if the parents were not married at the time of birth. Without legitimation, a father cannot seek custody or visitation rights.
How do I establish paternity?
Paternity can be established voluntarily with the mother’s agreement or through court-ordered DNA testing. Once paternity is confirmed, legal rights and obligations (like child support) may apply.
Can I get visitation if I establish paternity?
Establishing paternity alone doesn’t automatically grant visitation or custody. You must also file for legitimation to gain those rights. An attorney can guide you through both steps.
What if the mother doesn’t agree to legitimation?
